Criterion of guilt
To be able to find an attacker guilty of rape, it has to be proven that he acted with intent. “With intent” means either that he intended to rape, was certain a rape would take place, thought that a rape was highly likely, or considered a rape to be possible. Therefore, an intentional breach of the law is a deliberate – conscious – act. The attacker is deemed to be acting with intent when he realises that he is performing a criminal act.
